Welcome to Ritkalp.

These Terms & Conditions (“Terms”) govern your access to and use of the Ritkalp website, mobile or digital experiences, products, services, content and related offerings (collectively, the “Platform”).

The Platform is operated by Ritkalp Consumer Pvt Ltd (“Ritkalp”, “we”, “us” or “our”).

By accessing the Platform, creating an account, placing an order, submitting an enquiry, or using any Ritkalp product or service, you agree to these Terms and the other policies referenced in them.

If you do not agree with these Terms, please do not use the Platform.

1. About Ritkalp

Ritkalp is a consumer platform focused on making rituals and traditional practices easier to prepare for by providing ritual kits, puja essentials, related products, educational content, and selected ritual-related services.

Where a particular product or service is supplied by a third party, the applicable third-party terms may also apply.

2. Eligibility

You must be legally capable of entering into a binding contract under applicable Indian law to place an order or enter into a transaction with Ritkalp.

If you are under 18 years of age, you may use the Platform only with the involvement and supervision of a parent or legal guardian who is capable of entering into a binding contract.

By using the Platform, you represent that the information you provide is accurate and that you are legally entitled to use the Platform and enter into transactions with us.

3. Your account

Certain features may require you to create an account or provide information such as your name, mobile number, email address and delivery details. You are responsible for:

• Providing accurate and current information;
• Keeping your account credentials secure;
• Maintaining the confidentiality of passwords, OTPs and other authentication information;
• All activity carried out through your account, except where caused by circumstances beyond your reasonable control.

You must not use another person’s account or attempt to access an account, system or information without authorisation.

Ritkalp may suspend or restrict an account where we reasonably believe that the account is being misused, information is inaccurate, fraud is suspected, or these Terms or applicable law have been violated.

4. Communications

When you place an order or otherwise interact with Ritkalp, you agree that we may communicate with you electronically. This may include:

• Order confirmations;
• Payment confirmations;
• Shipping and delivery updates;
• Cancellation or refund updates;
• Customer-support communications;
• Important service or account notifications.

We may communicate through email, SMS, WhatsApp, telephone, in-platform notifications or other reasonable electronic means. Marketing communications, where applicable, may be managed in accordance with your preferences and applicable law.

5. Products and product information

We make reasonable efforts to ensure that product names, descriptions, quantities, images, prices and other information displayed on the Platform are accurate and useful. However:

• Product photographs may be illustrative;
• Natural products may vary in colour, size, shape, texture, grain or aroma;
• Handmade or traditionally prepared products may contain reasonable variations;
• Packaging may change from time to time;
• Availability may change without prior notice.

Where a product contains natural materials, reasonable natural variation does not by itself constitute a defect.

Where we do not have sufficient verified information about a product attribute, we may identify that information as unavailable or not yet disclosed rather than make an unsupported claim.

6. Ritual information and guidance

Ritkalp may provide ritual information, educational material, preparation guides, item explanations, festival information and other traditional or religious content. This information is provided for general educational and preparation purposes.

Ritual practices can differ between families, regions, communities, traditions, sampradayas, temples, and priests or purohits. Accordingly, Ritkalp does not represent that a particular list, procedure or method is universally applicable to every ritual or tradition.

Where a ritual is being performed according to a particular priest, family or tradition, you should confirm the final requirements with the relevant priest or authority.

Ritkalp does not guarantee any spiritual, religious, health, financial, personal or other outcome from following information provided through the Platform.

7. Product recommendations and ritual kits

Some Ritkalp products may be organised into kits or recommendations based on a particular ritual, occasion or use case. A kit is prepared based on the information available to Ritkalp and the intended use described on the relevant product page.

Unless expressly stated otherwise, a kit or recommendation should not be understood as a universal or mandatory list for every practitioner or tradition. If your priest or family has provided a specific list, you should follow that list where it differs from a general Ritkalp recommendation.

8. Prices

All prices displayed on the Platform are in Indian Rupees (₹), unless expressly stated otherwise. Prices may change from time to time.

The price applicable to your purchase is the price displayed at the time you place the order, subject to correction of obvious errors.

We may correct pricing, product or stock errors. If an obvious error materially affects an order already placed, we may contact you regarding the available options or cancel the affected order and refund any amount paid for it.

9. Taxes and charges

Applicable taxes, delivery charges and other charges will be displayed during the purchase process wherever required. The final amount payable will be shown before you complete payment. Any applicable promotional discount or offer will be subject to its specific terms.

10. Payments

Payments may be processed through third-party payment providers such as Razorpay or other payment partners made available on the Platform. Available payment methods may include UPI, cards, net banking, wallets, pay-on-delivery or other methods offered at checkout.

Payment transactions are subject to the terms and security procedures of the relevant payment provider and your bank or payment institution. Ritkalp does not intentionally store your full card credentials or UPI authentication credentials.

We are not responsible for a payment being declined, delayed or interrupted due to circumstances attributable to your bank, payment provider, network, device or other third-party system.

If your account is debited but the order is not successfully created, or if you are charged more than once for the same transaction, please contact us with the relevant transaction details so that we can investigate and process any applicable refund.

11. Placing an order

When you place an order, you are making an offer to purchase the selected products. An order is not considered finally accepted merely because you have completed payment or received an automated order acknowledgement. The order is accepted when Ritkalp confirms the order for fulfilment.

We may decline, restrict or cancel an order in reasonable circumstances, including:

• Product unavailability;
• Inability to deliver to the provided address;
• Incorrect or incomplete information;
• Suspected fraud or misuse;
• Payment or verification issues;
• An obvious pricing or listing error;
• Violation of these Terms;
• Operational or legal restrictions.

If a prepaid order is cancelled by Ritkalp, we will initiate the applicable refund for the cancelled amount.

12. Special, customised and made-to-order products

Certain products or offerings may be personalised, customised, made-to-order, prepared specifically for an occasion, assembled according to customer instructions, or arranged through individual enquiry. Additional terms may apply to such orders.

Once preparation or production has started, cancellation may not be possible unless otherwise agreed or required under applicable law. Any special terms applicable to a customised order will be communicated before or during confirmation wherever reasonably possible.

13. Delivery

Delivery timelines are estimates unless a specific delivery commitment is expressly provided. Delivery may be affected by weather, natural events, transport disruptions, strikes, courier delays, address-related issues, public holidays, network or technology failures, regulatory restrictions, or other circumstances outside our reasonable control.

Our Shipping & Delivery Policy forms part of these Terms. You are responsible for providing an accurate and complete delivery address and contact details.

If an order cannot be delivered because of an incorrect address, an unavailable recipient, repeated failed delivery attempts or other circumstances attributable to the customer, additional delivery charges or other reasonable arrangements may apply.

14. Cancellation, returns and refunds

Our Refund, Return & Cancellation Policy forms an integral part of these Terms. That policy explains when an order can be cancelled, when a product can be replaced, when a refund may be issued, how damaged, defective, missing or incorrect products are handled, which products are not eligible for return, and how refunds are processed.

Please review the Refund, Return & Cancellation Policy before placing an order. Nothing in that policy or these Terms is intended to exclude any consumer rights that cannot legally be excluded under applicable law.

15. User conduct

You agree to use the Platform lawfully and responsibly. You must not:

• Use the Platform for an unlawful purpose;
• Provide false, misleading or fraudulent information;
• Place fraudulent or abusive orders;
• Impersonate another person or organisation;
• Attempt to access another user’s account;
• Interfere with the operation or security of the Platform;
• Introduce viruses, malware or other harmful code;
• Attempt to bypass security or authentication measures;
• Scrape, crawl, copy or systematically extract Platform data without our written permission;
• Reverse engineer or attempt to obtain source code from the Platform except where permitted by applicable law;
• Use automated systems to place abusive or fraudulent orders;
• Upload or transmit content that is unlawful, defamatory, threatening, obscene, hateful or invasive of another person’s rights;
• Infringe intellectual-property, privacy or other rights of Ritkalp or any third party;
• Use the Platform to distribute spam or unsolicited commercial communications;
• Attempt to disrupt the Platform or impose an unreasonable load on our infrastructure.

We may restrict or terminate access where we reasonably believe these Terms or applicable law have been violated.

16. Reviews, ratings and user content

You may be able to submit reviews, ratings, photographs, comments, feedback or other content (“User Content”). By submitting User Content, you confirm that:

• It is substantially truthful and based on your genuine experience;
• You have the right to submit it;
• It does not infringe another person’s rights;
• It does not contain unlawful, abusive, misleading or malicious material;
• It does not contain another person’s private information without appropriate permission.

You grant Ritkalp a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and use your User Content for operating, improving and promoting Ritkalp, subject to applicable law and our Privacy Policy.

We may moderate, refuse to publish, edit or remove User Content that we reasonably believe violates these Terms or applicable law. We do not guarantee that every review submitted will be published.

17. Intellectual property

The Platform and its content, including the Ritkalp name and branding, logos and trademarks, product descriptions, photographs, graphics, illustrations, videos, guides, articles, website design, user interfaces, software, original written material and other proprietary content, are owned by Ritkalp or its licensors and are protected by applicable intellectual-property laws.

You may access and use the Platform for personal and lawful purposes. You may not copy, reproduce, modify, republish, distribute, commercially exploit, scrape, mirror or create derivative works from Ritkalp’s proprietary content without prior written permission, except where permitted by applicable law.

18. Third-party links and services

The Platform may contain links, integrations or references to third-party websites, payment providers, logistics providers, service providers or other external platforms. Those third parties operate under their own terms and privacy policies.

Ritkalp does not control every third-party platform and is not responsible for content, availability, security, policies or services provided independently by those third parties, except to the extent liability cannot legally be excluded.

19. Third-party ritual or spiritual services

Where Ritkalp facilitates access to or information about third-party service providers such as priests, pandits, astrologers, religious institutions or other service professionals, the specific service terms will apply. Ritkalp may facilitate discovery, booking, communication or payment, but this does not necessarily mean that Ritkalp is the provider of the underlying service.

Third-party providers may follow different traditions, methods, schedules or practices. Where applicable, details concerning a third-party provider are based on information provided by that provider or available to us and should be confirmed directly where important.

Ritkalp does not guarantee a particular spiritual, religious, astrological or other outcome from a third-party service. Where a third-party service is cancelled, rescheduled or otherwise unavailable, the applicable service-specific cancellation and refund terms will apply.

20. Safety and product use

Products must be used responsibly and according to any instructions, warnings or precautions provided with the product or on the Platform. Where a product requires special care or precautions, those requirements should be followed.

Ritkalp is not responsible for harm resulting from misuse of a product, failure to follow reasonable safety instructions, use contrary to stated instructions, modification or alteration of a product, or use for a purpose for which the product was not intended.

21. Disclaimer of certain warranties

We aim to keep the Platform accurate, secure and available, but we do not guarantee that:

• The Platform will always be available or uninterrupted;
• Every piece of information will always be complete or error-free;
• Every product will always remain in stock;
• The Platform will be free from technical errors or harmful components;
• Delivery will always occur within an estimated timeframe.

To the maximum extent permitted by law, the Platform and general informational content are provided on an “as available” basis. Nothing in these Terms excludes any warranty, representation or consumer right that cannot legally be excluded.

22. Limitation of liability

To the maximum extent permitted by applicable law, Ritkalp will not be responsible for indirect, incidental, special or consequential losses arising from your use of the Platform or products, including loss of profits, business opportunity, goodwill or data.

This limitation does not apply to liability that cannot legally be excluded or limited under applicable law. Ritkalp remains responsible for supplying products and services in accordance with applicable law and the commitments expressly made by us.

23. Events outside our control

We will not be responsible for failure or delay caused by circumstances reasonably beyond our control, including natural disasters, extreme weather, fire, flood, epidemics or public-health events, war or civil disturbance, government restrictions, strikes, transport or courier disruption, internet or telecommunications failures, payment-network failures, power failures, or other events beyond our reasonable control.

Where reasonably possible, we will communicate material delays or disruptions and take reasonable steps to resume performance.

24. Suspension and termination

We may suspend or restrict access to the Platform or an account where reasonably necessary to protect the Platform or other users, investigate suspected fraud or misuse, prevent unlawful activity, enforce these Terms, comply with applicable law, or address security concerns.

Termination or suspension will not affect rights and obligations that arose before the suspension or termination.

25. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Ritkalp, its affiliates, directors, employees, representatives and service providers from claims, losses, liabilities and reasonable costs arising from:

• Your material breach of these Terms;
• Your unlawful use of the Platform;
• Your fraud or intentional misconduct;
• Your infringement of another person’s rights; or
• Content submitted by you that violates these Terms or applicable law.

This clause will apply only to the extent permitted by applicable law.

26. Privacy and personal information

Your use of the Platform is also governed by our Privacy Policy and other applicable privacy notices. We collect and process personal information in accordance with applicable law and our published privacy practices. Please review the Privacy Policy for information about what we collect, why we collect it, how it is used and shared, and your available rights and choices.

27. Changes to these Terms

We may update these Terms from time to time to reflect changes in our business, products, services, technology or applicable law. The latest version will be published on this page with its updated date.

For orders already placed, the Terms applicable at the time of the order will generally govern that transaction, unless a change is required by law or expressly agreed otherwise. Your continued use of the Platform after an updated version is published constitutes acceptance of the updated Terms to the extent permitted by law.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible. The remaining provisions will continue to apply.

29. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.

30. Governing law and jurisdiction

These Terms are governed by the laws of India.
